By using the Perfumery Studio Marketplace, you agree to these guidelines in full. These guidelines form part of our Terms of Use and are binding on all users.

1. Eligibility
- You must be 18 years of age or older to buy or sell on the Marketplace.
- You must have a valid Stripe account (for sellers) and agree to Stripe's Terms of Service.
- You must not be under any legal restriction that prevents you from entering into commercial agreements.

2. For Sellers
What you can sell
- Original fragrance formulas you personally created
- Formulas where you own 100% of the intellectual property rights
- Formulas based on your genuine perfumery experience and knowledge
What is NOT allowed
- Copying, reproducing, or reverse-engineering another creator's formula
- Listing formulas you did not personally create
- Misrepresenting any ingredient, concentration, performance, or characteristic
- Creating fake listings, fake reviews, or manipulating the platform in any way
- Listing the same formula more than once under different names
- Listing formulas containing substances prohibited under EU Cosmetics Regulation (EC) No 1223/2009 or any applicable law
Pricing rules
- Minimum listing price: €10.00
- Maximum listing price: €100.00
- Prices must be honest and reflect the genuine value of the formula
- Artificial price inflation, price manipulation, or collusion with other sellers is prohibited
Your earnings
- You receive 90% of every completed sale, transferred directly to your bank account via Stripe
- Perfumery Studio retains 10% as a platform service fee
- Payouts are processed automatically by Stripe within 2–7 business days
- Perfumery Studio may adjust the commission rate with 30 days written notice
Tax responsibility
Sellers are solely and entirely responsible for declaring and paying all applicable taxes on their Marketplace earnings, including VAT, income tax, and any other tax obligations under Italian law, EU law, or the law of their country of residence. Perfumery Studio does not provide tax advice and accepts no liability for any seller's tax obligations.
Seller responsibilities
- Provide an accurate, honest title and description for every listing
- Only list formulas you have the legal right to sell
- Respond to disputes in good faith and within the required timeframe
- Keep your Stripe account active and verified at all times
- Ensure your formulas comply with all applicable laws and regulations

3. For Buyers
What you receive
- Full access to the purchased formula: all notes with exact concentrations
- Permanent access saved in your "My Purchases" account
- A personal, non-exclusive, non-transferable licence to use the formula for personal experimentation only
What you do NOT receive
- Exclusive rights to the formula — the seller retains all intellectual property rights
- Commercial rights to manufacture or sell products made from the formula without a separate written agreement with the seller
- Any guarantee that the formula will perform identically in all environmental conditions, with all materials suppliers, or at all scales of production
- The right to resell, redistribute, or sub-licence the formula in any form
Dispute policy
- You have 7 calendar days from the date of purchase to open a dispute
- Disputes must describe clearly how the formula was materially misrepresented
- Disputes are reviewed by our team within 3 business days
- Refunds are issued only if material misrepresentation is verified by Perfumery Studio
- No disputes can be opened after 7 days — no exceptions
No refunds
All sales are final. Refunds are issued only where Perfumery Studio determines, at its sole discretion, that the formula listing materially misrepresented the product. Buyer dissatisfaction, change of mind, or inability to reproduce the formula are not grounds for a refund.

4. Intellectual Property & Infringement Claims
If you believe a listing infringes your intellectual property rights, contact us immediately at support@perfumerystudio.com with:
- Your full name and contact details
- Identification of the original work and the infringing listing
- A declaration that the information is accurate to the best of your knowledge
Perfumery Studio will review claims and, where infringement is substantiated, remove the listing and take appropriate action against the seller. Perfumery Studio accepts no liability for infringement committed by sellers.

5. Platform Rights & Moderation
Perfumery Studio reserves the right to, at its sole discretion and without prior notice:
- Remove any listing that violates these guidelines or any applicable law
- Suspend or permanently ban accounts with violations
- Withhold payouts pending investigation of suspected fraud or policy violations
- Refund buyers and recover the corresponding amount from seller earnings in verified disputes
- Adjust platform features, commission rates (with 30 days notice), or marketplace availability at any time

6. Limitation of Liability
To the maximum extent permitted by applicable law:
- Perfumery Studio's total liability to any seller or buyer arising from a Marketplace transaction shall not exceed the commission earned by Perfumery Studio on the specific transaction in question
- Perfumery Studio is not liable for any indirect, incidental, consequential, or punitive damages
- Perfumery Studio is not liable for the acts or omissions of sellers, including inaccurate listings, formula defects, or intellectual property infringement
- Perfumery Studio is not liable for Stripe service interruptions, payment failures, or payout delays caused by Stripe or third parties
- Perfumery Studio is not liable for any loss, damage, or injury resulting from the use or misuse of a purchased formula

7. Force Majeure
Perfumery Studio shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to: Stripe outages, payment processor failures, cyberattacks, natural disasters, government actions, or changes in applicable law.

8. Governing Law & Jurisdiction
These guidelines and any dispute arising from Marketplace transactions are governed by Italian law. Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Italy. EU consumer protection regulations apply where mandatory by law.

9. Modifications
Perfumery Studio may update these guidelines at any time. Material changes will be notified with 15 days notice via email or platform notification. Continued use of the Marketplace after the effective date constitutes acceptance of the updated guidelines.

10. Important Disclaimer — Not Certified Formulations
Perfumery Studio is a creative platform for fragrance enthusiasts and hobbyists.
All formulas sold on the Marketplace are:
- Creative compositions shared for personal inspiration and experimentation only
- Not certified, tested, or approved by any regulatory authority (IFRA, EU, FDA, or any other body)
- Not professional cosmetic formulations — they do not come with safety assessments, stability testing, or regulatory compliance documentation
- Not intended for commercial manufacture or sale as consumer products without independent professional assessment
What this means for buyers:
- You are purchasing creative inspiration and a formula structure — not a ready-to-market product
- Before using any formula to manufacture products for sale to the public, you must obtain an independent safety assessment from a qualified cosmetic chemist and ensure compliance with EU Cosmetics Regulation (EC) No 1223/2009 or applicable local law
- Ingredient concentrations are provided as a starting point — actual safe usage levels may vary by skin type, application method, and intended use
What this means for sellers:
- You must not claim your formula is IFRA-compliant, EU-approved, or safety-tested unless you have independent documentation
- You must not imply that a buyer can use your formula to manufacture commercial products without further professional review
Perfumery Studio accepts no liability for any injury, reaction, regulatory violation, or loss resulting from the use, reproduction, or commercialisation of any formula purchased on the Marketplace.
